Complete Compliance & Audit Services

As of April 2023, the cannabis market in New Mexico is still in its early stages, as adult-use cannabis was only legalized in April 2021. However, there has been significant interest from operators looking to enter the market, and the state has already begun accepting license applications for cannabis businesses.

Currently, the New Mexico Regulation and Licensing Department (RLD) is responsible for overseeing the licensing and regulation of cannabis businesses in the state. The RLD is expected to issue licenses for cultivators, manufacturers, and retailers, among other types of businesses.

The licensing requirements for cannabis businesses in New Mexico are stringent and include detailed applications, background checks, financial disclosures, and proof of compliance with state and local zoning regulations. Applicants must also submit detailed business plans and demonstrate their knowledge of the industry and the regulations governing it.

As of now, there are no limits on the number of licenses that will be issued in New Mexico, but the RLD will prioritize applications from businesses that meet certain social equity criteria, such as those owned by individuals from communities disproportionately impacted by the war on drugs. Additionally, licensed businesses will be subject to ongoing regulatory compliance requirements, including regular inspections, reporting, and record-keeping.

Currently, there are only a few licensed cannabis operators in New Mexico, as the state is still in the process of accepting and reviewing license applications. However, some well-known cannabis companies have already expressed interest in entering the New Mexico market, and it is expected that there will be significant competition among businesses seeking to establish a foothold in the state's cannabis industry.

In terms of regulatory compliance considerations, cannabis businesses in New Mexico must adhere to strict rules governing everything from product labeling and packaging to testing and quality control. They must also follow state and local laws related to employment, taxation, and environmental protection.

Overall, the cannabis market in New Mexico is still evolving, but it presents significant opportunities for entrepreneurs and investors looking to enter the industry. However, those seeking to establish a cannabis business in the state must be prepared to navigate a complex and highly regulated landscape in order to succeed.

ICS has fully studied these new regulations and prepared to assist operators in this new market.
